What is hemp-derived, Delta-9 THC and is it legal?

Hemp-derived Delta-9 THC comes from cannabis plants with very low levels of THC. Less than 0.3% THC concentration qualifies a plant as Hemp and not Marijuana, making it federally legal under the 2018 Farm Bill. Hemp-derived THC is the same psychoactive compound found in marijuana, but is sourced from federally legal hemp. Hemp Delta-9 THC is infused into hemp beverages, like CannaBrew.

Update: On November 12, 2025, H.R. 5371 was signed. Section 781 of H.R. 5371 will impact the federal legality of Hemp Beverages beginning in November 2026, if no new legislation is put in place prior to that date. In the meantime, the products are not impacted and continue to be federally legal according to the 2018 Farm Bill.

CannaBrew is low calorie (70 calories per can) compared to light beer (95 to 100 calories), premium beers (can have 150 calories), and some IPA’s (can have 300 calories).
